GUIDANCE NOTE
REINSTATEMENT OF PUBLIC RIGHTS OF WAY
APPLICATION

These guidelines cover the reinstatement of Definitive Public Rights of Way which do not fall into categories defined in the reinstatement Code of Practice

Three types of Public Rights of Way have been identified for reinstatement purposes:-

Public Rights of Way which cross fields and are only subject to agricultural traffic.
Public Rights of Way which are not subject to vehicular traffic.
Public Rights of Way which are subject to occasional traffic for access purposes.

 

CORRESPONDING REINSTATEMENT TYPES

Backfill materials complying with material types Classes A to D is acceptable. The surface finish and depth of topsoil reinstatement is subject to Landowner's agreement

Backfill materials complying with material classes A to D to within not less than 50mm of the surface. Remaining 150mm, material to class A, GSB, with the surface blinded to match cosmetically the surrounding area.
Backfill materials complying with material classes A to D to within not less than 500mm of the surface. Remaining 500mm, material to class A, GSB, with the surface blinded to match cosmetically with the surrounding area.

Where there was originally a bound surface, the surface shall be constructed on a like for like basis.

Hand-over condition is to be in accordance with S2.2.6 of the Code of Practice "Specification For The Reinstatement of Openings in Highways".

 

GRASSED AREAS

Grassed areas are to be reinstated in accordance with S9 Paragraph 2 of the Code of Practice "Specification For The Reinstatement of Openings in Highways"

MAINTENANCE OF RIGHT OF WAY

Unless closed under the powers of the Road Traffic Regulation Act 1984, all Rights of Way are to be kept free of obstruction or an alternative route maintained as necessary for the duration of the works. All excavations are to be safely enclosed at all times.

DRAINAGE

Where reinstatements are carried out across agricultural land, care should be taken to ensure that agricultural drainage is not affected. Care should also be taken to ensure that the reinstatement materials do not form a drain which may result in an unauthorised discharge into a watercourse, or result in water being held in proximity to apparatus.
